GENERAL TERMS AND CONDITIONS OF TRAVELDOCS B.V.

 

  1.  General

 

  1.  Application range

    1.1.    These conditions form part of all agreements concluded with TRAVELDOCS, hereinafter referred to as “TRAVELDOCS”, and apply to all its offers.

    1.2.    The applicability of any general or specific conditions or stipulations of the other party of TRAVELDOCS, hereinafter referred to as: “Client”, is explicitly rejected by TRAVELDOCS. These general conditions prevail over the general or specific conditions or stipulations of the Client, even if the general or specific conditions or stipulations of the Client should determine the opposite.
    1.3.    By submitting one or more visa applications to TRAVELDOCS, the Client accepts the applicability of these General Terms and Conditions.
    1.4.    Terms and conditions deviating from these General Terms and Conditions are only binding if TRAVELDOCS has accepted them in writing and then only apply to the agreement in which they were made.

  2.  The assignment

    2.1.      The agreement between the Client and TRAVELDOCS is an assignment agreement as referred to in art. 7: 400 ff. Of the Civil Code (Burgerlijk Wetboek).

    2.2.     Article 7: 404 BW and Article 7: 409 BW do not apply.

  3.  Engaging third parties

    3.1.    TRAVELDOCS is entitled to engage third parties in the context of the execution of the assignment. TRAVELDOCS will do this as much as possible in consultation with the Client. TRAVELDOCS is not liable vis-à-vis the Client for any shortcomings or for any unlawful acts and / or omissions by the third party or parties engaged by it.

    3.2.     The costs of these third parties, plus a surcharge, will be for the account of the Client and will be charged to the Client by TRAVELDOCS.

  4.  Service contract

    4.1.      The services provided by TRAVELDOCS consist of applying for travel visas for the Client, Legalisations and possibly arranging invitations in the country of destination that are necessary to be able to apply for a visa.

    4.2.    The Client issues the order for services by e-mail, via the TRAVELDOCS website or otherwise.
    4.3.    TRAVELDOCS sends the Client an e-mail as confirmation of the assignment by which the agreement is concluded.
    4.4.    TRAVELDOCS provides the client with a list of the documents and forms that the client must submit in order to be able to provide the desired service.
    4.5.    TRAVELDOCS will not commence with the provision of services until after receipt of the documents and forms duly completed and signed by the Client.
    4.6.    The submission to TRAVELDOCS of the documents and forms truthfully completed by the Client counts as the explicit prior consent of the Client that TRAVELDOCS starts with the performance / implementation.
    4.7.    The Client has the authority to dissolve or cancel the agreement until the moment when the truthfully completed documents and forms have been delivered to TRAVELDOCS by or on behalf of the Client.
    4.8.    From that moment on, the Client no longer has a reflection period / right of withdrawal or cooling-off period.
    4.9.     TRAVELDOCS will endeavor to provide the Client with correct information to promote that the Client receives the visa in good time before the start of the trip. All visa requirements (documentation, costs, time frames, etc.) are based on general criteria and may vary depending on information provided by Client such as current or former nationality, place of residence, gender, age, profession, recent travel , religious beliefs etc.
    4.10.     The issuing authority may request additional documentation and / or information. The issuer may, without notice, change general requirements for certain countries or require additional specific information and / or impose additional specific requirements. TRAVELDOCS will endeavor to inform the Client of such changes as soon as possible. The Client will provide / fulfill that specific information and / or additional specific requirements as soon as possible.
    4.11.     TRAVELDOCS reserves the right, at its own discretion and without giving reasons, at any time to refuse to process a visa application and / or to terminate the processing of an ongoing application at any time, without the possibility of being addressed as liable by the Client for doing so. TRAVELDOCS will immediately notify the Client by e-mail if it refuses to process an application or terminates an application that has been processed in the meantime.
    4.12.    Upon receipt of his passport and the relevant documents, the client must immediately check whether he has received all visas required for his trip, whether the visas are valid for the countries he wishes to visit, whether the visas are valid before the arrival dates. and departure dates of his trip / visit and whether the visas are valid for the purpose and nature of his visit (tourism, business, study, etc.). If the Client finds any inaccuracy in the documents, it must immediately notify TRAVELDOCS via e-mail / portal.
    4.13.    TRAVELDOCS does not guarantee that the issuing authority will issue a visa or other in a timely manner and within the set time frame.
    4.14.     The issuing authority may reject an application for a visa, passport or other travel document for any reason and without stating reasons. TRAVELDOCS is never liable if visas or passports are refused, contain errors or are issued too late. In that case, TRAVELDOCS will continue to have and continue to be entitled to the agreed wages and reimbursement of the costs incurred c.a.
    4.15.     The Client must only purchase travel tickets or reservations that are not refundable after all visas and others have been obtained.
    4.16.     TRAVELDOCS will send the passport and visa by secured mail (courier), unless otherwise indicated. The delivery costs are for the account of the client and will be charged to the total amount due. TRAVELDOCS is never liable for delay or loss on delivery.

  5. Wages and payment

    5.1.    The costs for the services of TRAVELDOCS are determined on the website, including (any) indirect taxes that apply to the costs, and other charges and fees charged by an issuing agency or any courier or delivery service.

    5.2.    As soon as TRAVELDOCS submits an application for a travel document to an issuing authority on behalf of the Client, the costs of the services provided by TRAVELDOCS can no longer be claimed back from TRAVELDOCS by the Client.
    5.3.    Consular fees and service availability are subject to change without notice. Costs and services may change between the time the order is placed and the time the order is completed. TRAVELDOCS strives to communicate the aforementioned changes to the Client as soon as possible.
    5.4.    TRAVELDOCS reserves the right to select the most suitable service due to the time pressure indicated by the Client.
    5.5.    All costs paid by TRAVELDOCS to an issuing agency on behalf of the Client are non-refundable. In case a visa or passport application is submitted on behalf of the Client and the request is rejected for any reason, TRAVELDOCS will make an extra attempt to obtain the travel document at the Client’s request. The Client is obliged to pay any additional costs determined by the issuing agency and if the extra attempt is required due to a mistake made by the Client in a visa application, TRAVELDOCS is entitled to charge the costs mentioned above on the website.
    5.6.    For orders that are not submitted via the online order process, additional service costs may be charged, unless the TRAVELDOCS paid telephone number as stated on the site has been used.
    5.7.     TRAVELDOCS is authorized to hold passports and documents until full payment has been received.
    5.8.     TRAVELDOCS service fees may vary depending on the number of working days available to provide the service. Closing days and holidays of the consulate are excluded.
    5.9.      If an application is refused, the costs paid are non-refundable and TRAVELDOCS retains the full right to the agreed wages.
    5.10.     For orders that are canceled before the application is submitted to the relevant embassy or consular service, the Client will only owe the cancellation fee and any courier costs stated on the TRAVELDOCS website.
    5.11.     Once the application has been submitted to the appropriate agency, full costs will be due. Additional cancellation fees may apply to a withdrawal of the application.
    5.12.      Payment of the invoices of TRAVELDOCS and all that the Client owes to TRAVELDOCS must be made within 14 days of the invoice date, and no later than before the passport / visa / legalization is issued by TRAVELDOCS to the Client without suspension and / or setoff. The Client is not entitled to suspension and cannot settle any claims against TRAVELDOCS. The initially purchased service must be paid in advance. At upsale there will be a final bill to pay for the issue of travel document (s).
    5.13.     If the Client is more than one (legal) person, the Client is jointly and severally liable to TRAVELDOCS for all obligations arising from this agreement.

  6.     Liability limitation and expiry period

    6.1.  If a passport, document or other document is lost, ended up in the wrong place, is damaged, delayed or destroyed, TRAVELDOCS will only be liable if TRAVELDOCS has not acted as expected from a reasonably competent and reasonably acting contractor. TRAVELDOCS is never liable for more or other damage and costs than the replacement value / costs of the item. Liability for consequential and other damage is expressly excluded.

    6.2.     TRAVELDOCS is not responsible for documents that have been misplaced, damaged, delayed or destroyed by a delivery service or an issuing agency.
    6.3.     Passport covers and all documents such as original bank statements, education certificates and birth certificates etc. that are not required for submission according to the instructions of TRAVELDOCS must be retained by the Client. TRAVELDOCS accepts no responsibility / liability for the loss of or damage to such items / documents.
    6.4.     TRAVELDOCS will make every reasonable effort to process applications for visas, passports and / or documents. However, TRAVELDOS cannot be held responsible and is therefore not liable for the acts and / or omissions of a consulate, embassy, visa center or passport office in the event of postponement or failure to issue requested documents for any reason. TRAVELDOCS is not responsible or liable for any costs and / or delays arising from or in connection with: (a) incomplete application forms or (b) incorrect or falsely completed application forms or (c) incorrect or incomplete supporting documentation. All expenses incurred and outstanding by the Client, costs incurred and to be incurred and other damage suffered and damage to be suffered due to these delays and / or non-issued documents will be for the Client’s own account and risk and will never be recoverable from TRAVELDOCS.
    6.5.     TRAVELDOCS provides to the best of its knowledge and ability visa and passport information under the express condition that the aforementioned information is the interpretation of the information provided by the respective embassies, consulates, visa center or passport offices and TRAVELDOCS accepts no responsibility or liability for any errors, inaccuracies and / or omissions in that information and / or its interpretation.
    6.6.     TRAVELDOCS accepts no liability to travelers who wish to arrange their visas on arrival. To the fullest extent permitted by law, TRAVELDOCS excludes any liability in this respect for direct damage, indirect damage and consequential damage, without any limitation, including loss of profit and travel and holiday costs, including any liability for damage caused by information from the website. obtained.
    6.7.     Except in the event of intent or gross negligence and without prejudice to the other liability exclusions and limitations in these General Terms and Conditions, TRAVELDOCS ‘liability is at all times maximized to the amount paid by the Client to TRAVELDOCS.
    6.8.    The Client must inform TRAVELDOCS by registered letter of any claim regarding the service and / or shortcoming(s), within one month after the date of the delivery of the visa (or if not delivered, within two months from the date of the order). As soon as this period has expired, all possible rights and claims of the Client towards TRAVELDOCS have lapsed.
    6.9.     Without prejudice to the other provisions of these General Terms and Conditions, any legal claim of the Client against TRAVELDOCS will in any case lapse one year after the date from which the Client could have asserted any rights and / or claims against TRAVELDOCS.

  7.   Applicable law and disputes

    7.1.     All legal relationships between TRAVELDOCS and the Client are exclusively governed by Dutch law.

    7.2.     Disputes will – with the exclusion of any other court – (at first instance) be settled by the competent court in The Hague.

  8.  Final provisions

    8.1.    All terms in these general terms and conditions are also made by TRAVELDOCS for the benefit of its directors, its employees and third parties engaged by TRAVELDOCS. These clauses are therefore third-party clauses, which the persons referred to can also rely on.

    8.2.     If one or more provisions and / or stipulations in this agreement should be null and void or should be annulled, the other provisions and stipulations will continue to apply and the parties will consult in order to reach agreement on a replacement provision / replacement clause that will as much as possible have the same meaning as the null and void clause.
    8.3.     If TRAVELDOCS provides the client with a translation of these General Terms and Conditions, the client agrees that the translation is provided for convenience only and that the present Dutch version of the General Terms and Conditions always prevails over the foreign translation.
